36-795. Definitions. (2) "Kratom product" means a food product or dietary ingredient containing any part of the leaf of the plant mitragyna speciosa. (3)-(4) processor/retailer.
36-795.01. (A) A processor or retailer ... shall disclose on the product label the factual basis on which [the kratom] representation is made. (B) may not ... sell ... that does not conform to the disclosure ...
36-795.02. (A) A processor or retailer may not prepare, distribute, sell or expose for sale: 1. A kratom product adulterated with a dangerous nonkratom substance ...; 2. contaminated ... (incl. any controlled substance under chapter 27); 3. A kratom product containing a level of 7-hydroxymitragynine in the alkaloid fraction that is greater than two percent of the alkaloid composition of the product; 4. A kratom product containing any synthetic alkaloid, including synthetic mitragynine, synthetic 7-hydroxymitragynine or any other synthetically derived compounds of the kratom plant; 5. any kratom-containing product that does not include ... the amount of mitragynine and 7-hydroxymitragynine ... B. may not distribute, sell or expose for sale a kratom product to an individual who is under eighteen years of age.
