What the record says

9 NYCRR 114.8(d): concentrated cannabinoid hemp products for inhalation may not include polyethylene glycol (PEG) and may not contain flavors other than hemp-derived terpenes. This cartridge uses PEG 400 and non-hemp botanical terpenes, so two violations as made; switching to PG/VG and hemp-derived terpenes clears both. Formulation condition = restricted + EP. Penalty: OCM civil penalties under 9 NYCRR 114.17 ($1k / $5k / $10k), embargo. Score 3/10. Read on cannabis.ny.gov through the browser (code fetch is blocked by a challenge page). Product basis: Botanical Terpene Vape (admin product 1146), 1 mL cartridge, PG + PEG 400 + VG, non-hemp botanical terpenes, industrial hemp extract; product page lists THCV 1.91 mg/g, about 2.0 to 2.4 mg THCV per cartridge, delta-9 THC non-detect. Research source: Joel's Sept 30 / Oct 1 state block brief (project doc claude/botanical-terpene-vape-thcv-state-blocks-sept30.md, liberal standard); statute text re-verified on the official source 2026-10-07.
