As of October 8, 2026, Amanita muscaria / Muscimol is legal to sell at retail in Texas. Not named on Texas schedules or in any state law; edibles reachable only via general food-adulteration law. Controlling source: Tex. Health & Safety Code 481.103 (Penalty Group 2, hallucinogens).
Verified October 8, 2026 · confidence: confirmedNothing in Tex. Health & Safety Code Sec. 481.103 (Penalty Group 2) names Amanita muscaria, muscimol, or ibotenic acid (Justia/public.law fallback text fetched 2026-10-07; psilocybin is listed, these are not). Watch item: S.B. 1868 (89th R.S., 2025) would have added muscimol and ibotenic acid to Penalty Group 2 and created a hallucinogenic-plant chapter; it passed the Senate but died after referral to House Public Health on Apr. 28, 2025, and H.B. 291 and H.B. 227 in the two 2025 called sessions also failed. Expect a refiled version in the 90th Legislature (Jan. 2027). No Texas statute or rule names these compounds, so the only reach is general food adulteration law read with FDA's Dec. 18, 2024 determination that A. muscaria and its constituents are unapproved food additives, which does not reach inhaled products such as vapes. Analogue-act reach is remote because muscimol and ibotenic acid are not structurally similar to any Schedule I or II hallucinogen. Schedule checked 2026-10-08 on the official source (Tex. Health & Safety Code 481.103 (Penalty Group 2, hallucinogens)): Amanita muscaria, muscimol and ibotenic acid are not listed.
Sec. 481.103. PENALTY GROUP 2. Among Texas's 4 neighbors, Louisiana is illegal; Arkansas, New Mexico and Oklahoma are legal.
