any product derived from industrial hemp that contains any cannabinoid, including cannabidiol or THC, and is intended for consumption or topical use
As of October 8, 2026, CBG / CBDA / CBGA (hemp-derived) is in a legal gray area (sold in practice, exposed to an interpretive ban theory) in Louisiana as raw material / ruo. Exposure: Louisiana does not say whether bulk CBG isolate sold as an ingredient is itself a consumable hemp product that needs LDH registration and a permit, and Part VI's THC component definition literally covers every natural cannabinoid, including CBG. Because R.S. 40:961.1 protects only licensees and permittees, an unlicensed out-of-state seller's position is unclear. Controlling source: La. R.S. 3:1482, Consumable hemp products; prohibitions.
Verified October 8, 2026 · confidence: under_reviewLouisiana splits hemp between Part V (R.S. 3:1461-1473, Department of Agriculture and Forestry) and Part VI (R.S. 3:1481-1485, Department of Health and ATC). Extracting cannabinoids for use in consumable products is carved out of Part VI processing (R.S. 3:1481(2)), so an in-state buyer that further processes bulk CBG needs an LDAF processor license (R.S. 3:1465(A)(3)) or an LDH consumable hemp processor permit, and a permitted processor must potency test every distillate or concentrate it uses (R.S. 3:1483(A)(3)). R.S. 3:1482(A)(1) bars processing, distributing or selling any consumable hemp product without a permit, and R.S. 40:961.1 (Acts 2025, No. 233) exempts hemp from the controlled substances law only when handled by an LDAF licensee or a Part VI permittee, so an unlicensed out-of-state seller depends on the sale being an interstate B2B sale of an ingredient rather than of a consumable hemp product. Part V hemp is capped at 0.3% total delta-9 THC (R.S. 3:1462(10)), but Part VI defines "THC component" as any naturally occurring cannabinoid and counts it in "total THC" (R.S. 3:1481(13)-(14)), which read literally sweeps CBG in. CBG is not otherwise named, and the R.S. 3:1482(C)(2) ban on distillate containing non-naturally occurring THC derivatives does not reach extracted CBG. Per-serving caps, the age 21 rule and the inhalable ban are finished-product rules that do not apply to the bulk sale itself. Federal: from 2026-12-11 bulk CBG stays hemp only if it is plant-derived, at or under 0.3% combined total THC, and sold to businesses rather than consumers (7 U.S.C. 1639o(1)(C)(ii)-(iii)).
No person shall process, distribute, sell, or offer for sale any consumable hemp product without a permit required by this Part.
