Controlling language, verbatim

IC 35-48-1-17.5(a) - 'Low THC hemp extract means a substance ... contains not more than three-tenths percent (0.3%) total delta-9-tetrahydrocannabinol (THC), including precursors, by weight; and ... contains no other controlled substances.' IC 35-48-2-4(d)(31) - Schedule I includes 'Tetrahydrocannabinols ... including synthetic equivalents of the substances contained in the plant, or in the resinous extractives of Cannabis, sp.' [Delta-9 axis slips non-detect EPN; the synthetic-equivalent Schedule I theory + 'no other controlled substances' clause are the contested capture levers.]

Restricted/under-review - inhalable-hemp ban + Schedule I synthetic-equivalent-of-THC exposure; no clean lawful vape path. The limit is null (total ban). Indiana bans dealing in smokable/inhalable hemp (Class A misdemeanor), and IC 35-48-2-4(d)(31) schedules synthetic equivalents of tetrahydrocannabinols as Schedule I - a semi-synthetic THC-mimicking vape sits at the intersection of both, with no lawful inhalable path.

Controlling language, verbatim

IC 35-48-1-26.6 - 'Smokable hemp means a product containing not more than 0.3% delta-9-THC ... in a form that allows THC to be introduced into the human body by inhalation of smoke.' IC 35-48-1-17.5(a)(3) - low-THC hemp extract 'contains no other controlled substances.' [Smokable-hemp ban keyed to delta-9; synthetic-equivalent hook keyed to THC-equivalence - both contested for a non-detect novel semi-synthetic.]

Sec. 6. As used in this chapter, "hemp" means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than three-tenths of one percent (0.3%) on a dry weight basis, for any part of the Cannabis sativa L. plant. Sec. 6.5. As used in this chapter, "hemp product" means a product derived from, or made by, processing hemp plants or plant parts including derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers. However, the term does not include: (1) smokable hemp (as defined by IC 35-48-1-26.6); or (2) products that contain a total delta-9-tetrahydrocannabinol concentration of more than three-tenths of one percent (0.3%) by weight. Sec. 19. (a) Hemp bud (as defined in IC 35-48-1-17.2) and hemp flower (as defined in IC 35-48-1-17.3) may be sold only to a processor licensed under this chapter. (b) The state seed commissioner may impose a civil penalty under section 13 of this chapter for a violation of subsection (a).

Sec. 4. (a) The controlled substances listed in this section are included in schedule I.

(d) Hallucinogenic substances. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following hallucinogenic, psychedelic, or psychogenic substances, their salts, isomers, and salts of isomers whenever the existence of these salts, isomers, and salts of isomers is possible within the specific chemical designation (for purposes of this subsection only, the term "isomer" includes the optical, position, and geometric isomers):

(32) Tetrahydrocannabinols (7370), including synthetic equivalents of the substances contained in the plant, or in the resinous extractives of Cannabis, sp. and synthetic substances, derivatives, and their isomers with similar chemical structure and pharmacological activity such as:

(A) pi1 cis or trans tetrahydrocannabinol, and their optical isomers;

(B) pi6 cis or trans tetrahydrocannabinol, and their optical isomers; and

(C) pi3,4 cis or trans tetrahydrocannabinol, and their optical isomers.

Since nomenclature of these substances is not internationally standardized, compounds of these structures, regardless of numerical designation of atomic positions are covered. Other name: THC.

(g) Synthetic drugs as defined in IC 35-31.5-2-321.
