What the record says

The Va. Code 59.1-200(A)(69) synthetic-derivative ban reaches only substances 'intended for human consumption, orally or by inhalation.' A topical hemp product (Va. Code 3.2-4112: not intended for oral or inhalation consumption) falls outside that ban, but must bear a label stating it is 'not intended for human consumption' per Va. Code 59.1-200(A)(74). An HHC topical is therefore conditioned (labeling), not prohibited. Virginia is an EXPRESS synthetic-derivative-ban state for HHC. While natural hemp-derived delta-9 THC and its isomers (delta-8, delta-10) are sold lawfully in Virginia subject to the 0.3% total-THC / 2mg-per-package / 25:1-ratio industrial-hemp-extract framework and VDACS retail registration, HHC is a man-made hydrogenation product that meets the Va. Code 59.1-200(A)(69) definition of a 'synthetic derivative of tetrahydrocannabinol.' Selling or offering for sale any orally or inhalationally consumed HHC product is therefore a prohibited practice under the Virginia Consumer Protection Act, enforced by VDACS's Office of Hemp Enforcement. The only non-prohibited HHC channel is a topical product properly labeled 'not intended for human consumption' (Va. Code 59.1-200(A)(74)). Confidence confirmed: the operative statute, the definition, and VDACS's official interpretation (isomers-not-synthetic) were all read from official sources 2026-07-19.

Controlling language, verbatim

Selling or offering for sale any substance intended for human consumption, orally or by inhalation, that contains a synthetic derivative of tetrahydrocannabinol [is unlawful]. Inhalable HHC is a 'substance intended for human consumption ... by inhalation, that contains a synthetic derivative of tetrahydrocannabinol' and is therefore a prohibited practice under Va. Code 59.1-200(A)(69). VDACS's Oct. 2025 Guidance for Inhalable Hemp Products states isomers of delta-9 THC are NOT synthetic, but HHC is not an isomer of delta-9 THC -- it is produced by man through hydrogenation (adding hydrogen molecules), squarely within the statutory 'synthetic derivative' definition ('a chemical compound produced by man through a chemical transformation to turn a compound into a different compound by adding or subtracting molecules').

For the purposes of this definition, 'isomer' means the optical, position, and geometric isomers. 'Topical hemp product' means a hemp product that (i) is intended to be rubbed, poured, sprinkled, or sprayed on or otherwise applied to the human body or any part thereof and (ii) is not intended to be consumed orally or by inhalation.
