Is 5-MAPB Legal in Colorado? (2026)

Gray area

As of October 22, 2026, 5-MAPB is in a legal gray area (sold in practice, exposed to an interpretive ban theory) in Colorado. Analog-exposed - in-schedule analog catch-all (C.R.S. 18-18-203(2)(g)). Controlling source: C.R.S. Sec. 18-18-203(2)(g) - Schedule I in-schedule controlled substance analog; MDMA/MDA listed anchors at (2)(c).

What the record says

Mechanism: 5-MAPB is NOT named and no benzofuran appears in Schedule I. Reached by the in-schedule controlled-substance-analog catch-all C.R.S. 18-18-203(2)(g), which lists in Schedule I any analog whose structure is substantially similar to, or that was specifically designed to produce an effect substantially similar to/greater than, a substance listed in subsection (2), where intended for human consumption; MDMA (2)(c)(VII) and MDA (2)(c)(VI) are both listed anchors. Operative offense: C.R.S. 18-18-405 (generic Schedule I distribution/manufacture/possession-with-intent). The separate imitation-controlled-substances act 18-18-419/420 is appearance-based and NOT the hook. Basis INTERPRETIVE. Loose zone: whether a benzofuran is 'substantially similar' to MDMA/MDA or designed for a similar effect. Correction vs seed: none; re-verified (2)(g) verbatim on public.law (labeled mirror of the official leg.colorado.gov CRS Title 18 PDF). RENDER-DEBT: official PDF pull owed; mirror does not drive a hard illegal - status is restricted (analog), so mirror is acceptable.

**Schedule gap — § 18-18-203(2)(c):** lists "(IV.5) 5-methoxy-N,N-diisopropyltryptamine (5-MeO-DiPT); … (VIII.5) Alpha-methyltryptamine (AMT); (IX) Bufotenine; (X) Diethyltryptamine; (XI) Dimethyltryptamine (DMT); … (XXI) Psilocybin; (XXII) Psilocyn." **Analog provision — § 18-18-203(2)(g):** "Any material, compound, mixture, or preparation which is a controlled substance analog, the chemical structure of which is substantially similar to the chemical structure of a controlled substance listed in this subsection (2) or that was specifically designed to produce an effect substantially similar to or greater than the effect of a controlled substance listed in this subsection (2), all or part of which is intended for human consumption."
**Analog definition — § 18-18-102(6)(a):** "'Controlled substance analog' means a substance the chemical structure of which is substantially similar to the chemical structure of a controlled substance in or added to schedule I or II and: (I) Which has a … hallucinogenic effect on the central nervous system substantially similar to … a controlled substance included in schedule I or II; or (II) … the individual represents or intends [it] to have a … hallucinogenic effect … substantially similar …"
