What the record says

560-RICR-10-20-1 (eff. Dec. 8, 2025) requires a $500 retail license to sell hemp-derived consumable CBD products, limits sales to persons 21+ with ID checks, and caps post-harvest products at 1 mg total THC per serving, 5 mg per package, or 0.3% total THC dry weight. Allowed types include infused pre-packaged products consumed orally. 'Consumable' means ingestion by inhalation or oral intake by a human or animal, so pet products are covered. Labels must state total THC, CBD and other advertised cannabinoids per serving and package; no human, animal, fruit or cartoon shapes; no mixing with alcohol or nicotine. Topicals are not addressed. Applies to CBD ingestibles (oil/tincture, capsules, gummies, drinks). Limit noted: 1 mg total THC/serving, 5 mg/package (or 0.3%); $500 retail license; 21+; labeling. Pending: Federal: from 2026-12-11 the federal hemp definition excludes final hemp-derived cannabinoid products (ingested, topical or animal use) with more than 0.4 mg combined total THC per container (Pub. L. 119-37 div. B sec. 781, as delayed by Pub. L. 119-103 sec. 2019); full-spectrum CBD above 0.4 mg per container becomes marijuana federally in every state.

What the record says

The Rhode Island industrial hemp rule (560-RICR-10-20-1) expressly allows 'Raw hemp flower which may include raw hemp in pre-roll form' (1.11(G)(1)(a)), and 'consumable' includes intake by inhalation, so retail licensees ($500 fee) may sell to persons 21+ with ID checks (1.11(K)). Post-harvest products are limited to 1 mg total THC per serving, 5 mg per package, or 0.3% total THC on a dry weight basis; the flower-specific application is not spelled out, so test flower to 0.3% total THC. R.I. Gen. Laws 2-26-3 was amended by P.L. 2025, ch. 278 (eff. June 29, 2025) and keeps a 0.3% delta-9 hemp definition. Penalty: license action and product embargo under 2-26. Current rule effective Dec. 8, 2025. Applies to CBD cigarettes, pre-rolls and flower. Flags: sale ban False, manufacture-only ban False, shipping ban False, 21+ True, license True, total-THC flower test True. Pending: Federal: hemp redefinition limiting hemp-derived products to 0.4 mg total THC per container now takes effect 2026-12-11 (moved from 2026-11-12 by H.R. 6500, signed 2026-09-02, per Foley Hoag Sept 2026); a 0.3% total-THC pre-roll can exceed 0.4 mg per container.

(a) For purposes of this section, the following terms shall have the following meanings: (1) “Characterizing flavor” means a distinguishable taste or aroma, other than the taste or aroma of tobacco or menthol, distinguishable by an ordinary consumer, imparted either prior to, or during, consumption of an electronic nicotine-delivery system product or component part thereof, including, but not limited to, tastes or aromas relating to any fruit, mint, wintergreen, chocolate, vanilla, honey, candy, cocoa, dessert, alcoholic beverage, herb, or spice or which impart a cooling or numbing sensation.
