Verified October 22, 2026 (hash check) · confidence: confirmedLegal only within the licensed grower/handler/processor chain under Title 22 Chapter 17 at up to 0.3% delta-9 THC dry weight; becomes presumptively 'marijuana' the moment it is possessed without that license or leaves the licensed chain. Idaho's hemp definition technically permits up to 0.3% delta-9 THC dry weight at the plant/production level, but the 37-2701(u) presumption clause makes any detectable THC in a product possessed outside the licensed Farm Bill/state-plan supply chain presumptively 'marijuana'. Since Idaho has no general retail license for finished THC-bearing hemp products, ordinary retail sale of any delta-9 form is effectively illegal - confirming the seed's 'any THC illegal' framing. 2026 HB879 (in force as of 7/1/2026) reinforces this by explicitly folding retail sellers of ingestible/inhalable hemp products into the same licensing/compliance framework, with no new retail-license pathway created.
