What the record says

Hemp biomass/extract intended for further manufacture by a licensed processor is governed by the 0.3% total THC dry-weight cultivation/processing threshold (ORC 928.01(C), 928.02 licensure) rather than the 0.4 mg/container retail-product cap, which applies to 'final' and end-user-marketed 'intermediate' products. Ohio's post-SB56 framework (effective 3/20/2026) is structurally similar to New Jersey's: a hard, very low milligram-per-container total-THC ceiling (0.4 mg) determines whether a hemp-derived product remains general-retail 'hemp' or is reclassified as 'marijuana' requiring sale through one of a statutorily capped 400 licensed dispensaries statewide to adults 21+. Because typical commercial delta-9 THC dosing (single-digit milligrams per serving) vastly exceeds 0.4 mg per container, nearly all dosed hemp-derived delta-9 THC consumables and inhalables fall into the dispensary-only marijuana channel; only very-low-dose topicals and unprocessed/undosed raw material realistically stay under the retail hemp cap.

What the record says

Topicals formulated to stay at or below 0.4 mg total THC per container can remain classified as compliant hemp and be sold at general retail without dispensary licensure; those exceeding the cap are reclassified as marijuana.
