Vape extracts/cartridges are 'hemp products' under Mont. Code Ann. Section 16-12-117(3) and are capped at 0.5mg total delta-9 THC per serving / 2mg per package -- a dose too low to be meaningfully intoxicating, so lawful sale is possible only at near-homeopathic potency.

Controlling language, verbatim

Hemp and hemp products sold by any person may not exceed 0.5 milligrams of total delta-9 THC for each serving and may not exceed 2 milligrams of total delta-9 THC per package. This section does not apply to unadulterated hemp flower that is not further processed into extracts, infused products, or concentrates.

What the record says

Mont. Code Ann. Section 16-12-117(4): 'This section does not apply to unadulterated hemp flower that is not further processed into extracts, infused products, or concentrates.' Raw smokable hemp flower is therefore exempt from the 0.5mg/2mg caps and legal up to the standard 0.3% dry-weight hemp threshold. Montana takes a two-track approach: raw, unprocessed hemp flower is treated leniently (exempt from the mg caps, legal up to the standard 0.3% dry-weight threshold), while every processed/extracted hemp product (vape, edible, tincture, capsule, drink, etc.) is capped at 0.5mg delta-9 THC per serving and 2mg per package -- low enough to be non-intoxicating in practice. Anything above those caps must be sold as licensed marijuana through the state's regulated dispensary system under 16-12-222/223/224.

What the record says

Bulk/unprocessed hemp biomass for further processing is governed by Montana's hemp cultivation program (Title 80, ch. 18) rather than the 16-12-117 retail caps, which attach at the point of sale of a finished 'hemp product.' Montana takes a two-track approach: raw, unprocessed hemp flower is treated leniently (exempt from the mg caps, legal up to the standard 0.3% dry-weight threshold), while every processed/extracted hemp product (vape, edible, tincture, capsule, drink, etc.) is capped at 0.5mg delta-9 THC per serving and 2mg per package -- low enough to be non-intoxicating in practice. Compound Analytics. "Is Delta-9 THC (hemp-derived) Legal in Montana? (2026)." Compound Laws, https://compoundlaws.com/compounds/d9/montana/. Accessed October 25, 2026.

Compound Laws, published by Compound Analytics, reports the record: statutes verbatim, official citations, enforcement facts and verification dates. Nothing here is legal advice and nothing here describes how to get around a law. A jurisdiction with no verified row is reported as not yet verified, never as legal. Found an error?
