What the record says

Endomorphin-1 (Tyr-Pro-Trp-Phe-NH2) is not named or scheduled in Delaware. The state has a controlled-substance analogue/designer-drug statute whose effect prong can satisfy the test without structural similarity. It still does not operatively reach EM-1 as sold (see effect-prong scope / 'specifically designed' / human-consumption gate in the detail). Controlling instrument reviewed: 16 Del. C. 4701 (designer drug). Conclusion: no operative instrument reaches a structurally-dissimilar endogenous opioid peptide; status LEGAL at the state controlled-substances level. Residual risk: low. Federal floor still applies (Analogue Act human-consumption contingency + FD&C unapproved-new-drug).

Controlling language, verbatim

16 Del. C. 4701(10): "'Designer drug' means a substance that has a chemical structure substantially similar to that of a controlled substance or that was specifically designed to or may produce an effect substantially similar to that of a controlled substance. Examples of chemical classes ... include ... Phenethylamines, N-substituted piperidines, morphinans, ecgonines, quinazolinones, substituted indoles, arylcycloalkylamines, cannabinoids, cathinones ..." Excludes approved-new-drug / investigational substances. [Targets clandestine 'designed' small-molecule analogues.]

(10) Designer drug means a substance that has a chemical structure substantially similar to that of a controlled substance or that was specifically designed to or may produce an effect substantially similar to that of a controlled substance. Examples of chemical classes in which designer drugs are found include, but are not limited to, the following: Phenethylamines, N-substituted piperidines, morphinans, ecgonines, quinazolinones, substituted indoles, arylcycloalkylamines, cannabinoids, cathinones, and any synthetic analogue of a controlled substance. Designer drug does not include any substance that was manufactured, delivered or dispensed in conformance with an approved new drug application, or an exemption for investigating use within the meaning of Section 505 of the Federal Food, Drug and Cosmetic Act (21 U.S.C.
